GENERAL PROVISIONS

These general terms and conditions of sale (hereinafter, “General Conditions”) apply to all sales of products (hereinafter, “Products” or “Product”) purchased through the website www.biscottificiodalia.it (hereinafter “Site”). The use of the distance selling service described in these General Conditions is reserved exclusively for consumers (hereinafter “Customers” or the “Customer”), understood as natural persons who act for purposes unrelated to their commercial, business or professional activity. The language available for concluding the contract is Italian. The Customer is required to carefully read the General Conditions that have been made available on the Site, in order to allow their storage and reproduction by the Customer pursuant to art. 12 of Legislative Decree April 9, 2003, no. 70. Contracts concluded with Biscottificio D’Alia di D’Alia Francesco (hereinafter defined as Biscottificio D’Alia) through the Site are governed by Italian law and, in particular, by Legislative Decree September 6, 2005, no. 206 (“Consumer Code”) and by Legislative Decree April 9, 2003, no. 70 (hereinafter, “E-commerce Decree”).

PRICE

Product prices include all taxes and duties. All prices are expressed in Euros. Shipping costs are borne by the customer.

PRODUCT ORDERING

The essential characteristics and prices of the Products are shown in the offer relating to each Product. To purchase the Products, the Customer must complete and send the order form online in electronic format, following the instructions contained on the Site. The Customer must put the Product in the appropriate “cart” and, after reviewing the General Conditions, with particular reference to the contribution for delivery costs and the methods for exercising the right of withdrawal, and the Privacy Policy, must select the desired payment method and choose the “Confirm order” option. Before submitting their purchase order, the Customer will have the opportunity to correct any data entry errors by following the appropriate modification procedure contained on the Site. In particular, the Customer has the option to modify the quantity of Products they intend to purchase, adding or removing one or more Products from the “cart”. By sending the order, the Customer acknowledges and declares that they have reviewed all the information provided during the purchase procedure and fully accept the General Conditions. The Customer will be able to view and track the status of their order through the “Orders” area of their account. Biscottificio D’Alia reserves the right to evaluate the acceptance of received orders. Biscottificio D’Alia will communicate to the Customer any inability to accept received orders within 30 days from the day following the one on which the Customer transmitted the order to Biscottificio D’Alia and will provide a refund of any amounts already paid by the Customer for payment of the supply.

ORDER RECEIPT CONFIRMATION

In accordance with the provisions of art. 53 of the Consumer Code, the Customer receives, at the time of contract execution, by email, confirmation of receipt of the purchase order sent by the Customer, containing a summary of the General Conditions, the essential characteristics of the ordered product, its price, the amount paid, the existence of the right of withdrawal – with indication of the times and methods for returning the goods – the geographical address for submitting any complaints and information on assistance services and existing commercial guarantees.
